Acceptance of Terms

By creating an account on Grandma Bobbie ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms constitute a legally binding agreement between you and Grandma Bobbie LLC, a New Jersey limited liability company.

These Terms apply to all users of the Platform, including memorial owners, keyholders, visitors, and any other person who accesses or uses the Platform in any way.

Section 02

The Service

Grandma Bobbie provides a digital memorial platform that allows individuals to author, store, and publish their own obituary and life story while they are alive. The Platform includes the following features:

Digital Plot: A private, secure space where you author your memorial, upload photos, video, and audio, build a life timeline, write personal notes to loved ones, and designate charitable donations.
Keyholder System: The ability to designate one or more trusted individuals who hold the authority to activate your memorial upon your passing.
Memorial Activation: Upon verified death, your memorial is published exactly as you approved it, for the world to visit.
Visitor Tributes: A moderated space for visitors to leave tributes, reactions, and connect with other visitors through Grandma Bobbie.
Gentle Guide: An optional question-based tool to help you tell your story if you're not sure where to start.

Section 03

Eligibility

You must be at least 18 years of age to create a Grandma Bobbie account. By using the Platform, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

The Platform is intended for personal use only. You may not use the Platform on behalf of another living person without their explicit written consent.

Section 04

Your Account

You are responsible for maintaining the confidentiality of your account credentials, including your password and any biometric authentication (such as Face ID) you enable. You are responsible for all activity that occurs under your account.

You agree to notify us immediately at hello@grandmabobbie.com if you suspect any unauthorized access to your account.

Your memorial is entirely private while you are alive. Nothing in your account is visible to anyone — including your keyholder — until you explicitly press "Good to Go" to approve your memorial for publication, and until your keyholder activates it after your passing.

Section 05

Payment & Pricing

Grandma Bobbie charges a one-time fee for access to the Platform. All payments are processed securely through Stripe. Current pricing is as follows:

Your Digital Plot: $333 — one-time payment, yours forever.
Gift a Plot: $333 — a digital plot gifted to another person.
Two Plots Bundle: $444 total ($222 each) — one plot for you and one gifted plot.

All fees are in US dollars. There are no recurring charges, subscription fees, or renewal fees of any kind. Your plot is yours for as long as Grandma Bobbie operates.

Refund Policy: Because your plot is immediately created and secured upon payment, all sales are final. If you believe you have been charged in error, please contact us at hello@grandmabobbie.com within 14 days of purchase and we will review your case personally.

Section 06

Your Content

You own your content. Everything you write, upload, or create on Grandma Bobbie belongs to you. We claim no ownership over your story, your photos, your voice recordings, or your videos.

By uploading content to the Platform, you grant Grandma Bobbie a limited, non-exclusive, royalty-free license to store, display, and transmit your content solely for the purpose of operating the Platform and delivering the service to you and, after activation, to your memorial's visitors.

You represent and warrant that:

You own or have the right to use all content you upload.
Your content does not infringe the intellectual property, privacy, or other rights of any third party.
Your content does not contain material that is unlawful, defamatory, harassing, obscene, or otherwise objectionable.

Nothing is published without your consent. Your memorial remains completely private until you have pressed "Good to Go" to approve it for publication, and until your keyholder activates it following your verified passing. You may continue editing your memorial at any time before activation, and you may withdraw your "Good to Go" approval at any time while you are alive.

Section 07

Memorial Activation & Death Verification

Your memorial will only be activated and published upon verification of your passing. Grandma Bobbie requires the following documentation before any memorial goes live:

Death Certificate: A copy of the official death certificate, emailed to certificates@grandmabobbie.com by your designated keyholder.
Funeral Parlor Confirmation: Confirmation from the funeral home or mortuary handling arrangements, which our team will verify independently.

Our team personally reviews all submitted documentation. We aim to verify and activate memorials within 24 hours of receiving complete documentation. We reserve the right to request additional verification if we have reason to believe submitted documentation is inaccurate or fraudulent.

Fraudulent activation attempts are strictly prohibited. Any attempt to activate a memorial for a living person — including submitting false documentation — will result in immediate account termination and may be reported to the appropriate authorities.

Section 08

Tribute Moderation

All visitor tributes submitted to a live memorial are reviewed before publication. Grandma Bobbie uses a combination of automated screening and human review to ensure that all tributes are kind, respectful, and appropriate for a memorial space.

We reserve the right to decline, remove, or request revision of any tribute that we determine, in our sole discretion, to be harmful, cruel, false, offensive, or otherwise inappropriate. Posters whose tributes are declined will be notified privately and directed to contact us if they wish to discuss the decision.

Family members and designated contacts may flag tributes for review at any time. Flagged tributes are reviewed by our team within 24 hours.

Visitor connections — where one tribute poster wishes to contact another — are facilitated exclusively through Grandma Bobbie. We do not share contact information between visitors without the explicit consent of both parties.

Section 09

Deletion, Dormancy & Unfinished Memorials

You may delete your account at any time. Upon requesting deletion, your account and all associated content are immediately deactivated and hidden. You will have a 30-day recovery window during which you may contact us at hello@grandmabobbie.com to restore your account in full. After 30 days, your account, memorial content, and all associated personal data are permanently and irreversibly deleted from our systems. We will send you a reminder email before the 30-day window closes.

Dormant accounts are kept indefinitely. If you create an account and do not complete or activate your memorial, your account will remain active and private indefinitely. We will never delete a dormant account without your explicit request, because we understand that you may return to your story at any time.

Unfinished memorials remain unpublished. A memorial that has not received your "Good to Go" approval will never be published, regardless of what documentation a keyholder submits. You control when — and whether — your memorial is ever seen by the world.

Section 10

Prohibited Conduct

You agree not to use the Platform to:

Submit false, fraudulent, or misleading information, including fraudulent death documentation.
Create a memorial for another living person without their explicit consent.
Upload content that infringes the intellectual property or privacy rights of any third party.
Post tributes or content that is cruel, harassing, defamatory, obscene, or threatening.
Attempt to access another user's private memorial without authorization.
Use the Platform for any commercial purpose without our prior written consent.
Attempt to circumvent any security feature of the Platform.
Use automated tools to scrape, harvest, or collect data from the Platform.

Violation of these prohibitions may result in immediate account termination without refund.

Section 11

Intellectual Property

The Grandma Bobbie name, logo, platform design, and all original content created by Grandma Bobbie LLC are the exclusive property of Grandma Bobbie LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written permission.

Your content remains yours. Our content remains ours.

Section 12

Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. Grandma Bobbie does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

We make no warranty regarding the accuracy, completeness, or reliability of any content on the Platform, including tributes posted by visitors.

Section 13

Limitation of Liability

To the fullest extent permitted by applicable law, Grandma Bobbie LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to loss of data, loss of content, or emotional distress.

Our total liability to you for any claims arising out of or related to these Terms or the Platform shall not exceed the amount you paid to us in the twelve months preceding the claim.

Section 14

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of such courts.

Section 15

Changes to These Terms

We may update these Terms from time to time. When we do, we will notify you by email and update the "Last updated" date at the top of this page. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms.

We will never make changes that reduce your rights over your own content without your explicit consent.

How we handle your information.

Section 01

Information We Collect

When you use Grandma Bobbie, we collect the following categories of information:

Account information: Your name, email address, and password when you create an account.
Memorial content: Everything you write, upload, or record as part of your memorial — your story, photos, videos, audio recordings, timeline entries, personal notes, and faith information.
Keyholder information: The name and contact information of the individuals you designate as your keyholders.
Payment information: Payment is processed by Stripe. We do not store your full payment card information.
Usage data: Basic information about how you use the Platform, such as pages visited and features used, to help us improve the service.

Section 02

How We Use Your Information

We use your information for the following purposes:

To create and maintain your account and memorial.
To process your payment and provide the service you've purchased.
To notify your keyholder of their designated role.
To verify death documentation and activate memorials when appropriate.
To moderate visitor tributes and maintain the integrity of the Platform.
To facilitate visitor connections through our secure messaging system.
To send you important account communications — such as changes to these policies or security alerts.
To operate, maintain, and improve the Platform.

We will never use your memorial content for marketing, advertising, or any purpose beyond operating the service you've paid for.

Death Certificates & Sensitive Documents

Death certificates and funeral parlor confirmations are among the most sensitive documents we handle. We treat them accordingly.

When a keyholder submits a death certificate and funeral parlor confirmation to certificates@grandmabobbie.com, these documents are:

Received and reviewed exclusively by trained Grandma Bobbie staff.
Used solely to verify the passing of the memorial owner and activate the memorial.
Stored securely and encrypted at rest.
Never shared with third parties beyond what is strictly necessary for verification.
Retained for a period of 7 years for legal and compliance purposes, after which they are permanently deleted.

We independently verify funeral parlor confirmations directly with the funeral home. Submitted documents are never made public and are never associated with the published memorial.

Section 04

Sharing Your Information

We do not sell your data. We do not share your data with advertisers. Ever.

We share your information only in the following limited circumstances:

Stripe: Payment processing. Stripe is PCI-DSS compliant and handles all payment data under their own privacy policy.
Service providers: Trusted third-party vendors who help us operate the Platform — such as cloud storage and email delivery — under strict confidentiality agreements.
Your keyholder: We notify your designated keyholder of their role. They receive no access to your memorial content until it is activated.
Funeral homes: Only for the purpose of verifying death documentation, and only the minimum information necessary to do so.
Legal requirements: If required by law, court order, or to protect the rights, property, or safety of Grandma Bobbie, our users, or the public.

Payments & Stripe

All payments are processed by Stripe, Inc. Grandma Bobbie does not store, process, or transmit your full payment card information. Stripe handles all payment data in accordance with PCI-DSS standards.

Section 06

Cookies & Tracking

We use a minimal set of cookies necessary to operate the Platform — primarily to keep you signed in and remember your preferences. We do not use advertising cookies, behavioral tracking cookies, or third-party analytics that share your data with advertisers.

You may disable cookies in your browser settings, but doing so may affect your ability to use certain features of the Platform.

Section 07

Data Retention

We retain your data as follows:

Active accounts: Retained for as long as your account exists.
Dormant accounts: Retained indefinitely. We will never delete a dormant account without your explicit request. We understand that you may return to your story at any time, and that we cannot know when you will pass.
Deleted accounts: Upon your request, your account is immediately deactivated and hidden. You have a 30-day recovery window to restore it in full by contacting hello@grandmabobbie.com. After 30 days, all personal data and memorial content are permanently and irreversibly deleted. We will email you a reminder before the window closes.
Live memorials: Once a memorial is activated following your verified passing, it remains live on the Platform indefinitely, as your lasting legacy.
Death certificates: Retained for 7 years for legal compliance, then permanently deleted.
Payment records: Retained for 7 years as required by financial regulations.

Section 08

Your Rights

You have the following rights with respect to your personal data:

Access: You may request a copy of the personal data we hold about you.
Correction: You may update or correct your account information at any time through your account settings.
Deletion: You may request deletion of your account and all associated data at any time.
Portability: You may request an export of your memorial content in a standard format.
Objection: You may object to certain processing of your data, subject to applicable law.
California residents (CCPA): You have additional rights under the California Consumer Privacy Act, including the right to know what personal information we collect and the right to opt out of the sale of personal information. We do not sell personal information.
EEA and UK residents (GDPR): If you are located in the European Economic Area or United Kingdom, you have rights under the General Data Protection Regulation, including the right to erasure, the right to restriction of processing, and the right to lodge a complaint with your local supervisory authority.

Section 09

Children's Privacy

The Platform is not directed to individuals under the age of 18. We do not knowingly collect personal information from anyone under 18. If you believe a minor has created an account, please contact us at hello@grandmabobbie.com and we will promptly delete the account.

Section 10

International Users

Grandma Bobbie is operated from the United States. If you access the Platform from outside the United States, your information may be transferred to and processed in the United States, where data protection laws may differ from those in your country.

By using the Platform, you consent to the transfer and processing of your information in the United States. We take appropriate measures to ensure that international data transfers comply with applicable law.

We may update this Privacy Policy from time to time. When we do, we will notify you by email and update the "Last updated" date at the top of this page. We encourage you to review this Policy periodically.

We will never make changes that reduce your privacy rights without your explicit consent.
